Proposed regulation to extend the licence application period for water users in the Mount Lofty Ranges
The Department of Environment, Water and Natural Resources is consulting on a proposed regulation under the Natural Resource Management Act 2004 that will extend the licence application period for existing water users in the Eastern and Western Mount Lofty Ranges Prescribed Water Resources Areas who did not submit an application for a water licence during the statutory application periods in 2005-2006.
Following the prescription of the Eastern and Western Mount Lofty Ranges water resources in 2005, existing water users who could demonstrate water use, or a significant commitment to use water, during the relevant establishment periods were given six months to apply for a water licence.
It is proposed to introduce a regulation which allows water users who did not apply for a water licence before the close of the statutory application periods in 2006, a further opportunity to apply for a water licence that will enable them to lawfully continue accessing water in the future.
The proposed regulation applies to water users who took water for licensable purposes during the establishment periods of the Eastern and Western Mount Lofty Ranges Prescribed Water Resources Areas:
- Eastern Mount Lofty Ranges – 1 July 2000 to 16 October 2003
- Mount Lofty Ranges – 1 July 2001 to 14 October 2004.
Your comments are sought during a three-week consultation period from 12 September to 3 October 2012 on the draft regulation.
